Welcome to Rustans.com (the Site), which is part of Rustan Commercial Corporation (also referred to as "Rustan's" and "Rustans.com" in this site). This Site is operated by Rustan's.

By using this Site, you agree to be bound by these Terms of Use. Please review these Terms of Use carefully as they affect your legal rights. By using this Site and by ordering any of our products, you agree to be bound by the Terms of Use.

We may update or modify these Terms of Use. Check this page regularly to see the changes made to these Terms of Use. Any modifications to these Terms of Use will become effective when published on the Site. Your continued use of the Site after the changes constitutes your agreement to be bound by the amended Terms of Use.

I. Registration

You will need to register an account to use some of the services available to you on the Site. In registering an account, you agree to provide information about yourself that is true, accurate, current, and complete in all respects. You must also keep your information up-to-date by informing us of any changes by using the relevant sections of the site. You may refer to our Privacy Policy for more information on how we use your personal data.

To place an order with us, you must be at least 18 years old and must possess a valid credit or debit card issued by a bank acceptable to us.

If you are under 18, you must let your parent or guardian know about Rustan's Privacy Policy before you register to use the Site and the services. Rustan's reserves the right to only accept orders from you if you are 18 years old or over.

II. Prohibition and Failure to Comply

Rustans.com reserves the right to take actions against your account for activities, including, but not limited to:

1. Using other devices to attempt to hide the use of multiple accounts or disrupt any of our services;
2. Committing or encouraging a criminal offense;
3. Transmitting or distributing a virus, including, but not limited to, trojan horses, trap doors, back doors, easter eggs, worms, time bombs, cancelbots, or computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information;
4. Advertising or sending unsolicited messages of any kind;
5. Impersonating any other person or body or misrepresenting a relationship with any person or body;
6. Providing any kind of false information that is contrary to our interests and to any specific rule or requirement that we stipulate on the Site in relation to a part of the Site or the Site in general.

Rustan's reserves the right to terminate any account at its sole discretion, based on any of the aforementioned incidents. We shall send you an email to inform you of the termination of your account in such event.

III. Trademarks and Intellectual Property Rights

The Rustan's name and logo, and all related names, design marks, and slogans are the trademarks or service marks of Rustan's or our licensors.

All software and content (defined as, or includes, any text, audio or music, video, graphics, photographs, and images) are the intellectual property of Rustan's or our licensors and are protected by intellectual property and copyright laws and international treaty provisions.

The Site is for your personal and non-commercial use only. Any non-personal and/or commercial use of the content is only permitted when expressly authorized by Rustan's and/or its third party licensors. You may not distribute, reproduce, publish, sell, or license any software or content contained within the Site without prior written consent or authorization of Rustan's. Any such unauthorized actions may result in civil consequences or criminal penalties.

Rustan's reserves the right to withdraw or amend any item related to the services without notice. We will not be liable if for any reason the Site is unavailable at any time and for any period.

IV. Third Party Links

The Site may include links to other websites or resources that are not operated or prepared by Rustan's. We have no control over and accept no responsibility for the content of any site to which a link from the Site exists (unless we are the provider of those linked sites). Such linked sites are provided "as is" for your convenience only with no warranty, expressed or implied, for the information provided within them.

Rustan's is not responsible for the content or accuracy of any off-Site pages, which include, but is not limited to, advertisers of the Site. Use of these external websites or resources will be at your own risk and subject to the terms of use and service contained within each of such sites.

V. Product Descriptions

Rustan's aims to ensure that the content and the product descriptions on the Site are as accurate and complete as possible. We, however, do not warrant that the content and product descriptions are accurate, complete, current, or error-free. Please refer to our Returns Policy if you feel a product offered by Rustan's is not as described.

VI. Eligibility to Purchase

In order to place orders with us, you must meet our conditions of eligibility:

1. Be at least 18 years of age or over;
2. Own a valid credit/debit card issued by a licensed bank acceptable to Rustan's for payment, or be in possession of a valid PayPal account;
3. Provide personal and payment details that are warranted by you to be both valid and accurate (email address, real name, phone number, billing information, and other requested information as indicated on the Site)

You authorize Rustan's to process a charge or charges on your credit/debit card or PayPal account in the amount of the total purchase price when you place an order with us. If your card issuer refuses to authorize payment to Rustan's, we will not be liable for any delay or non-delivery.

You also authorize us to use your personal information provided by you to perform appropriate anti-fraud checks, such as credit checks, and to, where necessary, transmit or obtain information about you to or from third parties, including but not limited to, credit reference or fraud-prevention agencies, which may keep a record of that information. Please refer to our Privacy Policy for further information about how we use your data.

Prices are inclusive of Value Added Tax (VAT). Delivery charges will be indicated in the Checkout page. All charges are stated in Philippine Peso.

All orders are subject to stock availability and confirmation of the order price. Items in your shopping bag are not reserved and may be purchased by other customers.

The Site is for your personal use only. You may not purchase goods from the Site for reselling purposes or commercial exploitation.

VII. Acceptance of Order

Rustan's reserves the right to not accept an order for any reason at its sole discretion. Such reasons include, but are not limited to, any one of the following:

1. The product you ordered is out of stock or is withdrawn due to its failure to meet our quality standards;
2. Shipping restrictions applicable to one or all of the ordered items;
3. We are unable to obtain authorization of payment;
4. You do not meet the eligibility criteria to purchase as set out in the Terms of Use.

VIII. Shipping and Collections

You will be given an indication of the expected delivery time when you place your order online. Rustan's will try its best to meet these estimates but cannot guarantee that such estimates will be met.

Rustans.com insures each order through transit up until it is delivered to you or is collected.

You need to sign a confirmation of receipt of the products when the products are collected and by doing so, you accept the responsibility for the products ordered from that moment on. If the recipient or collector is not the original purchaser, or in case of delivery of a gift, then you accept this signature as an evidence of delivery and fulfillment of your order by Rustan's.

You also accept the associated transfer of responsibility in the same way.

Rustan's may provide free shipping on all orders above a certain amount from time to time or as stated at Checkout and promotions.

Rustan's reserves the right to update its shipping policy at its sole discretion without prior notice.

IX. Returns and Refunds Policy

Products ordered through the Site may be returned for a refund or exchange if they are returned unused, in their original condition, and with their original packaging. You must return the item/s within 15 days of receiving the order and provide a proof of purchase as well as initiate the returns process at our Returns Page. Returns/exchanges are subject to exclusions and restrictions that are listed below.

 

If you received an incorrect item or noticed a missing part, please refrain from using the item to ensure a smoother return or exchange process.

 

The following items are not valid for returns: fine jewelry, underwear, lingerie, hosiery and socks, swimwear, cosmetics, fragrances, skincare, and items on final sale.

 

Clothing

Please exercise extreme care when trying on garments. Only merchandise that is unworn, unaltered, undamaged, in fully sale-able condition per Rustan's standards, and with original and authentic labels, tickets, or tags affixed to the original merchandise will be accepted for return. All accessories (including all belts, slips, chains, straps, and any other included or attached accessories) must be included as new for the items to be accepted for return.

 

Bags

Please exercise extreme care when handling bags. Dyes from clothing and other materials can transfer to light-colored bags. Only bags unaltered, unworn, undamaged, in fully sale-able condition per Rustan's standards, and with original and authentic labels, tickets, or tags affixed to the original merchandise will be accepted for return. All accessories must be included (including all dust bags, straps, mirrors, cards, charms, and any other attached accessories) and be unaltered, undamaged, and in fully sale-able condition to be accepted for return.

 

Shoes

Shoes with scratched soles or with any markings whatsoever on the soles will not be accepted for return. Trying on shoes on soft, clean, indoor surfaces, such as carpeting, is recommended, but does not guarantee that a return will be accepted. Returns must include the original shoe box and dust bag, if any, as these are considered part of the product. All shoe boxes and shoe accessories (including all straps, laces, extra heel caps, and any other included or attached accessories) must be included and be unaltered, undamaged, and in fully sale-able condition to be accepted for return.

 

Beauty

Skin care, cosmetics, hair care, fragrances, nail polish, and aerosol products cannot be returned due to transport restrictions.

 

Lingerie, Underwear, Swimwear, Hosiery and Socks

Lingerie, underwear, swimwear, hosiery, and socks cannot be returned due to reasons of hygiene.

 

Fine Jewelry

Fine jewelry and watches with value greater than ₱5,000 cannot be returned via courier. Instead, you must return your package at the Rustan's Makati Customer Service. For your protection, fine jewelry returns must be insured by you for its full value as Rustan's will not be liable for any lost or damaged fine jewelry or watches over ₱5,000 while they are in transit for return transactions.

 

Note that all returns will be inspected upon receipt at our store or warehouse for authenticity and condition. You will be contacted by our Customer Service team if there are any questions related to the merchandise being returned.

X. Vouchers

Promotional vouchers—in the form of codes—may be issued by Rustans.com from time to time during certain promotions.

Rustan's shall be entitled to close your account and/or require a different means of payment in the event of fraud, an attempt at deception, or the suspicion of other illegal activities in connection with a promotional voucher on the Site.

XI. Disclaimer of Liability

The content displayed on this Site is provided without any guarantees, conditions, or warranties as to its accuracy. Unless expressly stated to the contrary and to the fullest extent permitted by law, Rustan's and its suppliers, content providers, and advertisers hereby expressly exclude all conditions, warranties, and other terms which might otherwise be implied by statute, common law, or the law of equity. They shall not be liable for any damages whatsoever, including, but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data, or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance, or failures of this Site and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law, or otherwise.

Rustan's shall not have any liability (whether in contract, tort, negligence, misrepresentation, restitution, or under any legal form of liability) in relation to your use or inability to use or delay in use of the Site or any material in it or accessible from it or from any action or decision taken as a result of using the Site or any such material for any:

1. Indirect or consequential losses, damages, costs, or expenses;
2. Loss of actual or anticipated profits;
3. Loss of contracts;
4. Loss of use of money;
5. Loss of anticipated savings;
6. Loss of revenue;
7. Loss of goodwill;
8. Loss of reputation;
9. Loss of business;
10. Loss of operation time;
11. Loss of opportunity; or
12. Loss of, damage to, or corruption of data, whether such losses were reasonably foreseeable, or we had been advised of the possibility of you incurring such losses.

XII. Indemnity and Waiver

You agree to indemnify, defend, and hold harmless Rustan's, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages, and/or costs (including, but not limited to, legal fees) arising from your use of this Site or your breach of the Terms of Use.

XIII. Complaints

Rustan's shall perform its obligations under these Terms of Use with reasonable skill and care.

We place great value on our Customer satisfaction. You may email us or use live chat on our Site for any complaints or inquiries and we will seek to respond within 24 business hours.

In rare cases, your emails may be caught up in our spam filters or not reach us, or correspondence that we send to you may otherwise not have reached you. Should you not have received any response from us within five (5) business days, please make further inquiries.

XV. Governing Law

These Terms of Use and your use of the Site (and all non-contractual relationships arising out of or connected to it or them) shall be governed by and construed in accordance with Philippine laws. You submit to the exclusive jurisdiction of Philippine courts to settle any dispute which may arise under these Terms of Use.
